Supreme Court Extends Stay on Abortion Pill Restrictions

The Supreme Court on Thursday extended its administrative stay blocking enforcement of a lower court ruling that would have restricted access to the abortion pill mifepristone. The order allows telehealth prescribing and mail distribution of the drug to continue while the legal battle proceeds.

The decision maintains current FDA rules permitting patients to obtain mifepristone without an in-person doctor visit.

Justice Clarence Thomas dissented from the court's order. Justice Samuel Alito filed a separate dissent.

The case arises from challenges to FDA changes that expanded access to mifepristone in 2023. Those changes permitted telehealth prescribing and mail distribution.

A Fifth Circuit ruling had sought to reinstate prior in-person dispensing requirements. The Supreme Court's action temporarily blocks the Louisiana court's restrictions as the case moves through the courts.
