Man Charged in Fatal Hit-and-Run Faces ICE Detainer Over Suspected Illegal Status
Victor Napoleon Reyes, 33, faces an ICE detainer after authorities charged him with three counts of negligent homicide in a hit-and-run crash that killed a mother and her two young sons.
The crash occurred around 9:15 p.m. Sunday on Arch Street near Dixon Road. Reyes drove a 2016 Chevrolet Silverado that crossed the center line and struck a Buick head-on, according to Arkansas State Police. Breu’hna Hall, 31, and her sons, 4-year-old Dax Barnes and 2-year-old Dyce Love, died from their injuries. Reyes fled on foot, and police arrested him Tuesday afternoon after a two-day search.
Jail records show Reyes held at the Pulaski County Detention Center on a $350,000 bond with an ICE hold. His attorney, Bill James Jr., told Channel 7 News that Reyes lacks legal status in the United States.
"As far as being in the country… I do not believe he has legal status here, no," James said. He added the ICE hold likely stemmed from the arrest. "If someone is arrested, and they are believed to be illegal, a lot of times ICE will put a hold on them," he said. James noted, "you’re not going to get an ICE hold unless you’re in custody."
James said that if Reyes posts bond, authorities could release him to ICE. "If he bonds out, then he’ll be released to ICE, and then it’ll be up to ICE whether they take him or not," he told Channel 7 News.
Legal records obtained by Channel 7 News show Reyes pleaded guilty to DWI in the first degree in 2016 and to DWI in the second degree plus driving on a suspended license in 2023. James said those offenses do not prove negligence in this crash. "Whether he’s done something in the past doesn’t automatically mean he was negligent in this case," he said. He added that Reyes's immigration status "certainly makes it easier to charge those folks," but acknowledged probable cause exists.
Reyes pleaded not guilty and returns to court July 1. Family described Hall as a devoted mother and "a joy to be around." She leaves a 12-year-old daughter, whom relatives plan to support. A GoFundMe seeks funds for funeral costs and family aid.
