Trump Criticizes Justices Gorsuch and Barrett Over $159 Billion Tariff Ruling
President Donald Trump criticized two Supreme Court justices he appointed after their vote in a $159 billion ruling against his tariffs. In a 545-word Truth Social post Sunday night, Trump voiced frustration with Justices Neil Gorsuch and Amy Coney Barrett over the decision and a pending case on birthright citizenship.
"I don't want loyalty, but I do want and expect it for our Country," Trump wrote. He said the justices showed "so little respect to our country, and its people." Trump noted he has "another way of doing Tariffs, but it is far slower, and more laborious than what was just determined, in a close decision, to be 'illegal' or 'unconstitutional,' with three powerful, and highly accurate, dissents!"
Trump predicted the court would rule against his position on birthright citizenship, calling it unsustainable on top of the tariff loss. "A negative ruling on Birthright Citizenship, on top of the recent Supreme Court Tariff catastrophe, is not Economically sustainable for the United States of America!" he wrote.
The birthright citizenship case remains pending, with a decision expected before the end of June or in early July. Trump seeks to end birth tourism, where foreign nationals give birth in the U.S. to secure citizenship for their children.
The Supreme Court issued a 6-3 decision in late February against Trump's use of the International Emergency Economic Powers Act for tariffs on national security and trade grounds. Gorsuch, Barrett and Chief Justice John Roberts joined liberal Justices Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson in the majority.
Justices Clarence Thomas, Samuel Alito and Brett Kavanaugh dissented on the constitutionality of the tariffs amid multiple wars.
"I 'Love' Justice Neil Gorsuch! He’s a really smart and good man, but he voted against me, and our Country, on Tariffs, a devastating move," Trump wrote. He said the ruling cost the U.S. $159 billion that must be repaid to adversaries and others who have exploited the country.
Trump faulted the decision for leaving the door open to repayment claims, though the ruling did not expressly allow it. "They could have solved that situation with a 'tiny' sentence, 'Any money paid by others to the United States does not have to be paid back,'" he wrote.
Trump said certain Republican-nominated justices make court packing unnecessary for Democrats. He urged conservative justices to interpret the law with loyalty to the people and ideology they represent, as Democrat justices do.
"I'm working so hard to, MAKE AMERICA GREAT AGAIN, and then people that I appointed have shown so little respect to our Country, and its people," Trump added. "Sometimes decisions have to be allowed to use Good, Strong, Common Sense as a guide."
