Court Overturns Adoption After Mother Dates Prisoner at Her Workplace
A two-year-old boy's adoption has been overturned after his adoptive mother failed to disclose her relationship with a prisoner at her workplace.
Lord Justice Peter Jackson ruled in the Court of Appeal that the boy had been formally adopted by a married couple in Northumberland in November 2025.
Social workers recently learned the adoptive father had moved out in October and the mother had started a new relationship.
Barristers for Gateshead Council argued the adoption was unfair to the child because it relied on mistaken information.
The judge noted the prisoner was serving time for drug offenses and had prior convictions for battery and possession of weapons. He had also faced accusations of child sex offenses, though no action followed.
The man was released in March but returned to prison in April after arrest for breaching license conditions. Police charged him with threatening behavior and criminal damage at the adoptive mother's home, Jackson said.
Social workers discovered the woman was caring for the prisoner's XL bully dog. She had taken the boy to visit the prisoner twice, and the man had started calling the child his stepson.
Authorities removed the boy from the mother's care in March and placed him with his adoptive father. Gateshead Council then moved to overturn the adoption.
The adoptive mother had told the council she wanted no further involvement with the child.
Jackson said the boy had received a high standard of care from his adoptive parents, whom social workers described as loving him unconditionally.
"The consequence of each of these errors was that the court acted on a fundamentally mistaken basis," he said.
